Pete Burns had his bag nicked by a man who attacked him in central London in the early hours of Tuesday morning.
It was reported the Dead Or Alive singer, 49, and husband Michael Simpson were arrested, after they were seen in a police car.
But the pair were actually being driven home by officers after the incident.
'A member of the public kept persisting to take a picture of Pete Burns,’ says his spokesman.
'When Pete declined, an argument between Pete and the guy started.
‘Pete got up and walked away but the other person ran after him and pulled his hair and kicked him in the back.
‘The police were called and while they waited for the police, Pete went inside the restaurant.
'While Michael followed him inside, the person who assaulted Pete stole Pete's bag containing bank cards, a mobile phone and keys to his house.
‘When the police arrived to take all the details they offered to take them back to Pete's address.’
