Britney Spears claimed she was too ill to attend court on Wednesday to be quizzed about her lifstyle, but was snapped out partying that evening.
Now Kevin Federline's lawyer Mark Vincent Kaplan is said to be so furious, he's set to ask custody Judge Scott M. Gordon to bar Britney from trying to regain custody rights of her boys.
‘This is the fourth time Britney has skipped the deposition,’ a source tells TMZ.com.
‘Kaplan feels she should not be allowed to go into court and ask to restore custody if she won't sit for a deposition to determine if she really is a fit parent.'
Kevin, 29, currently has full custody of Sean Preston, 2, and 15-month-old Jayden James and Brit, 26, has 3 supervised visits a week.
They have agreed to share custody over the Christmas holidays, but Mark may even appeal for Britney’s current visitation rights to be withdrawn.
